General Terms and Conditions (GTC)
 
Swisscover.ch – An online shop of Renggli Ventures GmbH
 
1. Scope
 
These General Terms and Conditions (GTC) apply to all orders in the online shop www.swisscover.ch
, operated by Renggli Ventures GmbH.
The offer is aimed exclusively at customers residing or having their registered office in Switzerland or the Principality of Liechtenstein.
By placing an order, the customer accepts these General Terms and Conditions in their currently valid version.
 
2. Offer and conclusion of contract
 
All information in the online shop (products, prices, availability) is non-binding and does not constitute a legally binding offer.
 
A binding purchase contract is only concluded upon confirmation of shipment by Swisscover.ch.
 
Changes to product range, prices and conditions remain reserved at any time.
 
3. Prices
 
All prices are quoted in Swiss francs (CHF).
 
Pricing and printing errors excepted.
 
Price changes after an order has been completed are excluded.
 
4. Payment
 
Purchase on account (payable within 14 days, maximum order value CHF 120).
 
In case of late payment: interest of 10 % pa plus reminder fees:
 
1st reminder by email: CHF 0.–
 
2nd reminder by post: CHF 20.–
 

Costs for late payment: After at least 2 written reminders, the case will be forwarded to a debt collection agency, which will charge a processing fee according to www.fairpay.ch raises.

 
Swisscover.ch reserves the right to only process orders against advance payment.
 
5. Delivery
 
Delivery exclusively to addresses in Switzerland and the Principality of Liechtenstein.
 
Shipping is usually done via Swiss Post (economy shipping CHF 2.80).
 
Delivery time is usually 1-3 working days.
 
The risk for shipping passes to the customer upon handover to the carrier.
 
6. Returns and exchanges
 
Returns are possible within 14 days provided the goods are unused, undamaged and in their original packaging.
 
Return costs are borne by the customer.
 
Returns are only accepted after prior registration.
 
Refunds will be issued after inspection; direct exchanges are not possible (new order required).
 
 
 
 

6a. Bewertungen, falsche Tatsachenbehauptungen und Rechtsverfolgung

Renggli Ventures GmbH (Webshop: SwissCover.ch) ist bestrebt, Beanstandungen und Reklamationen kundenfreundlich und unkompliziert zu lösen, beispielsweise durch Ersatzlieferung, Nachbesserung oder Rückerstattung.

Kundinnen und Kunden steht es selbstverständlich frei, ihre persönliche Meinung und ihre tatsächlichen Erfahrungen mit SwissCover öffentlich zu äussern. Berechtigte Kritik sowie wahrheitsgemässe negative Bewertungen werden durch diese Bestimmung ausdrücklich nicht eingeschränkt.

Nicht zulässig sind hingegen insbesondere wissentlich falsche, nachweislich unwahre, irreführende oder rufschädigende Tatsachenbehauptungen, welche geeignet sind, Renggli Ventures GmbH, SwissCover.ch oder deren Produkte und Dienstleistungen geschäftlich oder reputationsmässig zu schädigen.

Wird Renggli Ventures GmbH auf eine möglicherweise falsche Tatsachenbehauptung aufmerksam, kann die betroffene Person aufgefordert werden, den Sachverhalt innerhalb einer angemessenen Frist zu überprüfen, richtigzustellen oder nachweislich falsche Aussagen zu entfernen.

Werden nachweislich falsche oder rufschädigende Tatsachenbehauptungen schuldhaft und trotz entsprechender Aufforderung weiterhin verbreitet oder nicht korrigiert, behält sich Renggli Ventures GmbH ausdrücklich vor, rechtliche Schritte einzuleiten, insbesondere die Beseitigung oder Berichtigung der betreffenden Aussagen sowie gegebenenfalls Schadenersatz zu verlangen.

Bei einer schuldhaften Verletzung dieser Bestimmung kann, soweit gesetzlich zulässig, eine Konventionalstrafe von bis zu CHF 500.– geltend gemacht werden. Weitergehende gesetzliche Ansprüche bleiben vorbehalten.

Sämtliche durch eine schuldhafte Rechtsverletzung verursachten und rechtlich ersatzfähigen Kosten können gegenüber der verantwortlichen Person geltend gemacht werden. Dazu können insbesondere angemessene vorprozessuale Rechtsverfolgungskosten, Anwaltskosten, Gerichts- und Verfahrenskosten sowie zugesprochene Parteientschädigungen gehören. Die endgültige Kostentragung richtet sich nach den anwendbaren gesetzlichen Bestimmungen beziehungsweise nach einem gerichtlichen Entscheid.

 
 
7. Warranty and guarantee

7.1 Scope of warranty
Swisscover.ch grants a warranty period of twelve (12) months from the date of delivery on all products purchased in the online shop. This warranty covers only material and manufacturing defects.

7.2 Type and scope of the guarantee
In the event of a warranty claim, Swisscover.ch will only replace the product with an identical or equivalent product.

  • A refund of the purchase price as well as a reduction of the purchase price are expressly excluded.

  • For each purchased item, a maximum of one (1) replacement product can be obtained.

7.3 Procedure in the event of a warranty claim
The customer is obligated to report the warranty claim immediately in writing and to submit a detailed description of the defect and, where possible, photographic evidence. Swisscover.ch reserves the right to request the return of the defective product for inspection.

7.4 Exclusion of warranty
In particular, damage caused by:

  • improper use or manipulation,

  • normal wear and tear,

  • unauthorized modifications or repairs by third parties,

  • Effects of force majeure.

7.5 Legal warranty
To the extent permitted by law, the statutory warranty is excluded and replaced by the above guarantee.

 
8. Product representations
 
Illustrations, descriptions and technical information in the shop are non-binding and may differ from the delivered product.
 
Manufacturers reserve the right to make changes at any time.
 

9. Disclaimer

A disclaimer of liability applies in particular in the following cases:

  • improper or incorrect handling of the items,

  • natural wear and tear,

  • External influences (e.g. falls, impacts or water damage),

  • improper self-installation of replacement and repair items.

Further claims by the customer – regardless of the legal basis – are excluded.

Swisscover.ch is not liable for damage not caused to the delivered product itself. The installation and use of spare parts or accessories from the Swisscover.ch range are expressly at the customer's own risk and responsibility.

Should the installation or use of spare parts and accessories result in damage or destruction to the associated device or product, or should an existing warranty become void as a result, Swisscover.ch assumes no liability whatsoever.

This also applies to Consequential damages, indirect damages, lost profits or financial lossesThe same applies to injuries sustained by the customer during installation or use of spare parts or accessories supplied by Swisscover.ch.

 
10. Retention of title
 
The goods remain the property of the Renggli Ventures GmbH.
 
11. Changes to the Terms and Conditions
 
Swisscover.ch reserves the right to change these Terms and Conditions at any time. The version valid at the time of the order applies.
 
12. Applicable law and place of jurisdiction

All legal relationships are subject to Swiss law.
